Private Sector Employees Criticize Indonesian Civil Servants’ Long Holiday

Collective leave falls after or before certain national holidays. The government’s determination of collective leave is stipulated in a joint decree (SKB) of three ministers concerning National Holidays and Collective Leave.

The government recently added collective leave to the 2025 calendar, designating August 18, 2025, as collective leave to commemorate the 80th anniversary of the Republic of Indonesia.

According to Ministerial Decree No. 3 of 2022 concerning collective leave for private companies, collective leave reduces employees’ annual leave according to the decisions and regulations of each company.

“The implementation of collective leave as referred to in Dictum FIRST reduces the annual leave entitlement of employees/staff/workers in accordance with the provisions of laws and regulations and the provisions applicable to each work unit/organizational unit/institution/company,” reads point five of Ministerial Decree No. 3 of 2022.

Collective leave for workers in the private sector is optional. This means that collective leave regulations are not mandatory for both employees and private companies.

Therefore, private sector employees are permitted to skip collective leave to avoid reducing their annual leave allowance.

For civil servants (ASN/PNS), collective leave does not deduct from their annual leave allowance. This is stipulated in Presidential Decree of the Republic of Indonesia Number 2 of 2025 concerning Collective Leave for State Civil Apparatus Employees in 2025.

“Collective leave as referred to in the FIRST dictum does not deduct from the annual leave entitlement of State Civil Apparatus Employees,” reads the second point of Presidential Decree Number 2 of 2025.

“State Civil Apparatus Employees who, due to their position, are not entitled to collective leave, their annual leave entitlement shall be increased by the amount of collective leave not granted,” reads the third point of the Presidential Decree.

Therefore, civil servants (ASN/PNS) remain on leave during collective leave in accordance with government regulations. Collective leave for civil servants (ASN/PNS) does not deduct from their annual leave entitlement.
